§ 1 Scope of Application
These terms apply to contracts for the delivery of goods between you, the customer, and us, Messer Rödter, concluded solely via means of distance communication (e.g., email orders).
Your own general terms only apply if we agree to them in written or text form. If you are a business customer, these terms also apply to future contracts.
§ 2 Conclusion of Contract
The goods presented on our website serve as a product showcase. They do not constitute a binding offer. Your order constitutes a binding offer to enter into a contract. Consumers have the right to withdraw this offer (see § 3).
Upon receipt of your electronic order, we will confirm its receipt by email (order confirmation). This confirmation does not constitute acceptance of your offer. Acceptance occurs either by explicit confirmation or dispatch of the goods.
The contract is concluded only upon our acceptance. We may accept your order within ten working days. Upon acceptance, we will send you the contract text and these terms again in text form. The contract is concluded in German.
Contract Storage: We store the contract text and send you the order details and our GTC by email. Past orders can be viewed in your customer login.
§ 3 Right of Withdrawal for Consumers
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date you or a third party named by you (other than the carrier) take possession of the goods.

by an unequivocal statement (e.g., letter, fax or email). You may use the attached withdrawal form but are not required to. Upon receiving your withdrawal, we will confirm receipt (e.g., via email). It is sufficient to send your withdrawal before the withdrawal period ends.
§ 4 Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except additional costs from a non-standard delivery option), within 14 days of receiving your withdrawal.
Refunds will be made using the same payment method you used unless agreed otherwise. No fees will be charged for the refund. We may withhold the refund until we have received the goods back or proof of return.

no later than 14 days after informing us of your withdrawal. The deadline is met if you send the goods before the 14-day period expires. You bear the direct costs of returning the goods.
You are only liable for any diminished value if it results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion of the Right of Withdrawal: No right of withdrawal exists for distance contracts for:
Goods made to customer specifications or clearly personalized
Sealed goods not suitable for return due to health or hygiene reasons if unsealed

Please frank returns properly and send them as insured packages. Avoid damage and contamination. Return items preferably in their original packaging.
EU Country Return Rules: Consumers in the listed countries generally bear return shipping costs, unless otherwise regulated.
§ 5 Delivery
Goods in stock are shipped immediately after order acceptance and payment receipt. Items not in stock may take longer, especially customized products. Delivery times are shown in product descriptions or with order acceptance.
Refusal to accept goods does not constitute valid withdrawal. The buyer is obligated to pay and accept. Refusing delivery without proper withdrawal makes the buyer liable for damages (§ 304 BGB).
If suppliers fail to deliver ordered goods through no fault of our own, we may withdraw from the contract and will inform you promptly and refund any payments.
Goods are sent as insured packages. Shipping costs are specified in § 6.
§ 6 Prices, Costs, and Minimum Order Value
All product prices include German VAT. Orders from outside the EU are VAT-exempt.
A flat rate of €6.90 applies for packaging and shipping within Germany. For other countries, see the "Shipping Costs" section of our shop.
For cash on delivery, an additional fee of €8.99 applies.
Any customs duties or taxes for international shipments are your responsibility.
Minimum order value is €20.
§ 7 Payment Terms
Payment methods: advance bank transfer, in-store cash payment, PayPal, PayPal PLUS (Direct Debit, Credit Card), and – within Germany – cash on delivery.
Payment is due immediately upon contract conclusion. Cash on delivery includes an €8.99 fee.
§ 8 Retention of Title
Goods remain our property until fully paid. For business customers, this includes all claims from the business relationship.
§ 9 Warranty
Warranty is provided according to legal regulations. For used goods purchased by businesses, warranty is excluded. For consumers, warranty for used items is one year.
§ 10 Set-Off and Retention
You may only offset claims that are legally established or undisputed. Right of retention only applies if based on the same contract.
§ 11 Data Protection
Our website can be used without revealing personal data. IP address, referrer URL, and visited pages may be logged anonymously for statistics.
Personal data (e.g., name, address) is only collected if you provide it voluntarily for contract processing. Data is used only for that purpose and deleted afterward. Data is treated confidentially.
We are not responsible for content on third-party websites linked from ours. Our privacy policy does not apply there.
§ 12 Legal Jurisdiction and Place of Fulfillment
German law applies, excluding UN purchase law, unless prohibited by Art. 29 EGBGB.
Court jurisdiction for commercial clients is Hof/Saale. This is also the place of fulfillment.
§ 13 Code of Conduct
We do not adhere to any particular code of conduct.
§ 14 Packaging Law
We comply with the German Packaging Act via Landbell AG, Mainz (Customer No. 4107528). More info at www.landbell.de.
§ 15 Shipping Methods
Shipping options: free in-store pickup, DHL with new packaging, or DHL in eco-friendly recycled packaging. For detailed shipping costs, see "Shipping and Delivery" section on our website.
