These Terms and Conditions apply to all contracts for the delivery of goods concluded between Messer Rödter, owner Susann Frécôt e.K., and customers via our online shop, e-mail, telephone or other means of distance communication.
Customers within the meaning of these Terms and Conditions are consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity acting in exercise of their commercial or self-employed professional activity.
Any deviating terms and conditions of the customer shall only apply if expressly confirmed by us in text form.
The presentation of goods in our online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
By placing an order, you submit a binding offer to conclude a purchase contract. Receipt of your order will be confirmed immediately by e-mail. This confirmation does not yet constitute acceptance of your offer unless acceptance is expressly declared therein.
The contract is concluded only when we expressly confirm your order, dispatch the goods or request payment.
The contract language is German. We store the contract text and send you the order details together with these Terms and Conditions by e-mail. If a customer account exists, previous orders can be viewed there.
All prices include the applicable statutory VAT unless otherwise stated.
Shipping and packaging costs are charged additionally. The applicable shipping costs are displayed during the ordering process, within the offer or under “Shipping Costs”.
For deliveries within Germany, we charge a shipping and packaging fee of EUR 6.90 unless otherwise stated.
For deliveries outside Germany, additional customs duties, taxes, import charges or customs clearance fees may apply. These costs are to be borne by the customer.
The minimum order value is EUR 20.00.
The following payment methods may be offered: advance bank transfer, PayPal, PayPal PLUS, credit card, direct debit, cash payment upon collection and cash on delivery where available.
Unless otherwise agreed, payment is due immediately upon conclusion of the contract. In the case of advance payment, shipment takes place after receipt of payment.
Additional carrier fees may apply for cash on delivery shipments.
Delivery is made to the delivery address specified by the customer.
Items in stock are generally shipped promptly after conclusion of the contract and receipt of payment. Delivery times are stated in the product description, offer or order confirmation.
For unavailable goods, custom-made products or specially ordered items, delivery times may be extended. Customers will be informed accordingly.
If an ordered item is unavailable because we are not supplied by our own supplier through no fault of our own, we reserve the right to withdraw from the contract. Payments already made will be refunded immediately.
Customers are requested to accept the goods upon delivery and, if transport damage is visible, to report it immediately to the carrier. Statutory rights remain unaffected.
Refusal to accept a shipment alone does not constitute a formal withdrawal from the contract. Consumers should therefore additionally declare the withdrawal clearly, for example by e-mail, letter, fax or via our electronic withdrawal form.

If unjustified refusal of acceptance causes additional costs, we reserve the right to claim such costs where legally permissible.
The goods remain our property until full payment has been received.
For entrepreneurs, we retain ownership of the goods until all claims arising from the ongoing business relationship have been settled in full.
Consumers are entitled to a statutory right of withdrawal. Details are set out below.
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

by means of a clear declaration, for example by letter or e-mail, of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract.
Additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us are excluded from reimbursement.
We will use the same means of payment for reimbursement that you used for the original transaction unless expressly agreed otherwise.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earlier.
You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal.
The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
The right of withdrawal also does not apply to sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
This applies in particular to hygienically sealed shaving, grooming, manicure and pedicure items.

Certain items are sold only to persons who have reached the legally required minimum age. We reserve the right to request suitable proof of age before conclusion of the contract or before delivery.
Customers are themselves responsible for observing the laws and regulations of their country regarding purchase, possession, import, use and carrying of the ordered items.
The statutory warranty rights apply.
For used goods sold to consumers, the warranty period is one year from receipt of the goods.
