General Terms and Conditions

The following provisions regulate all processes in the modernized osCommerce online shop in a transparent, legally secure, and completely barrier-free manner for all end devices. Our discerning customers benefit from clearly defined standards, reliable order processing, and customer-oriented advice at the highest level.

§ 1 Scope of Application
These General Terms and Conditions apply to all contracts for the delivery of goods between MESSER RÖDTER, Owner Susann Frécôt e.K., and our customers, which are concluded via our online shop, by e-mail, by telephone, or via other means of distance communication. Customers within the meaning of these terms and conditions are consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction. Deviating conditions of the customer only apply if we have expressly agreed to their validity in text form.

§ 2 Conclusion of Contract
The presentation of goods in our online shop does not constitute a legally binding offer, but rather a non-binding invitation to order. By placing your order, you submit a binding offer to conclude a purchase contract. The receipt of your order will be confirmed immediately by e-mail. This confirmation of receipt does not yet constitute an acceptance of your offer, unless acceptance is expressly declared therein. The purchase contract is only concluded when we expressly confirm your order, dispatch the goods, or request payment from you. The contract is concluded in the German language. The text of the contract will be stored by us and transmitted to you by e-mail together with these General Terms and Conditions. You can view your order data in your customer account, provided that a customer account exists.

§ 3 Prices and Shipping Costs
All prices include the applicable statutory value-added tax, unless expressly stated otherwise. In addition to the product price, shipping and packaging costs apply. The respective applicable shipping costs are displayed during the ordering process, in the offer, or under the menu item "Delivery and Shipping Costs". For deliveries within Germany, unless stated otherwise, we charge a flat-rate shipping and packaging fee of 6.90 Euro. For deliveries outside of Germany, additional costs such as customs duties, taxes, import duties, or customs clearance fees may arise. These costs are to be borne by the customer and are not payable to us, but to the competent customs or tax authorities. The minimum order value is 20.00 Euro.

§ 4 Payment
The following payment methods may be offered: prepayment by bank transfer, PayPal, PayPal PLUS, credit card, direct debit, cash payment upon collection, as well as cash on delivery, provided this payment method is available in the individual case. Payment is due immediately after conclusion of the contract, unless agreed otherwise. In the case of prepayment, shipping takes place after receipt of payment. In the case of cash on delivery, additional fees of the transport service provider apply. These are indicated during the ordering process or in the offer.

§ 5 Delivery
Delivery is made to the delivery address specified by the customer. In-stock goods are generally dispatched promptly after conclusion of the contract and receipt of payment. The respective delivery time results from the product description, the offer, or the order confirmation. In the case of goods not in stock, custom-made products, or articles ordered according to customer requirements, the delivery time may be extended. We will inform the customer about this. Should an ordered article not be available because we are not supplied by our supplier through no fault of our own, we reserve the right to withdraw from the contract. Payments already made will be reimbursed immediately in this case.

§ 6 Acceptance of Delivery
The customer is requested to accept the goods upon delivery and to complain about transport damages to the delivery agent immediately if possible. Legal rights of the customer remain unaffected by this. A mere refusal of acceptance does not replace an express declaration of revocation. Consumers should therefore additionally declare a revocation clearly, for example by e-mail, letter, fax, or via our electronic revocation form. If additional costs arise due to an unjustified refusal of acceptance, we reserve the right to assert these, provided there is a legal basis for this.

§ 7 Retention of Title
The goods remain our property until full payment has been made. Vis-à-vis entrepreneurs, we retain ownership of the goods until full settlement of all claims arising from the ongoing business relationship.

§ 8 Right of Revocation
8.1 Consumers are generally entitled to a right of revocation.
8.2 Further information on the right of revocation results from the revocation policy of the seller.
8.3 The right of revocation does not apply to consumers who do not belong to a member state of the European Union at the time of the conclusion of the contract and whose sole place of residence and delivery address are outside the European Union at the time of the conclusion of the contract.

§ 9 Proof of Age and Statutory Restrictions
The sale of certain articles is only made to persons who have reached the statutory minimum age. We reserve the right to request appropriate proof of age before the conclusion of the contract or before delivery. Customers themselves are responsible for compliance with the statutory regulations of their country regarding the acquisition, possession, import, use, and carrying of the ordered articles.

§ 10 Warranty
The statutory warranty rights apply. For used goods, the warranty period for consumers is one year from receipt of the goods.

§ 13 Choice of Law and Jurisdiction
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Hof.

The contents of this website are subject to German copyright law. Any use outside the legal limits requires our prior written consent.
